Oh excrement Badger is going to get mediaeval on your derriere now. And I don't know the answer, Diamond Head never had a major label deal but I don't know who owns the rights to their songs. Like most bands of their era that are still going, they've had a bunch of different members so it might be that whoever owns the rights to the song isn't in the band any more.
If Artist B records a ‘cover’ of Artist A’s composition, Artist B only owns the rights to that recorded version of the composition. Artist A owns both the composition and their own sound recording of the composition.
OK. In this case the song was written by Sean Harris and Brian Tatler, the two founding members of Diamond Head. Sean Harris left Diamond Head in 2003. Does he or could he still have claim over the composition even though he is no longer in the band?
